A federal appeals court denies a bid to block release of special counsel Jack Smith’s report on Donald Trump’s efforts to overturn his 2020 election loss.

Special counsel Jack Smith’s report on his election subversion and January 6, 2021, investigation of Donald Trump can be made public, a federal appeals court ruled Thursday, while leaving in place a lower judge’s three-day hold that could give Trump time to ask the Supreme Court to intervene.

The judges left in place a lower-court injunction that bars the disclosure of the report for three days, and the Justice Department then appealed it.

The president-elect’s lawyers said public release of the special counsel report would violate his right to an orderly transition to the presidency.

The Justice Department told a federal appeals court on Wednesday that Attorney General Merrick Garland intends to release the January 6-related volume of its final report of special counsel Jack Smith before Donald Trump takes office.

An appeals court gave Garland permission to release one volume of Jack Smith’s special counsel report after Trump fought to keep it under wraps.

The ruling means Trump can ask the Supreme Court to block the release of the report written by special counsel Jack Smith. A spokesperson for Trump did not say whether the president-elect would appeal Thursday's ruling but instead attacked Smith in a statement.
